1. Acceptance of Terms

By accessing or using NavyAI's API service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

You must be at least 18 years old to use our Service. By using NavyAI, you represent and warrant that you meet this age requirement.

2. Service Description

NavyAI provides a unified API gateway to access multiple AI language models, image generation services, and other AI-powered capabilities from various providers including:

OpenAI (GPT models, DALL-E, Whisper)
Google (Gemini models, Imagen)
Anthropic (Claude models)
Mistral AI
Other third-party AI providers

NavyAI acts as an intermediary service. We do not develop or control the underlying AI models.

3. API Access and Usage

3.1 API Keys

API keys are generated through our Discord bot using the /key command
Each key is unique and tied to your Discord account
You are responsible for keeping your API key secure
Sharing, selling, or publicly exposing your API key is prohibited
Lost or compromised keys cannot be recovered

3.2 Usage Limits

Token limits are based on your subscription plan
Daily token usage resets at midnight UTC
Rate limits apply to prevent abuse (requests per minute)
Exceeding limits will result in temporary request blocking

3.3 Fair Use Policy

The Service is intended for reasonable API usage
Automated scraping or bulk data extraction is prohibited
Attempting to reverse-engineer or bypass our systems is forbidden
We reserve the right to throttle or suspend accounts showing abusive patterns

4. User Obligations

As a user of NavyAI, you agree to:

Comply with Laws: Use the Service in compliance with all applicable laws and regulations
Respect AI Provider Terms: Adhere to the terms of service of underlying AI providers
Accurate Information: Provide accurate account information
Security: Maintain the security of your API credentials
Responsible Use: Use AI outputs responsibly and ethically
Content Ownership: Ensure you have rights to any content you submit

5. Prohibited Uses

Violation of these prohibitions may result in immediate account termination without refund.

You may NOT use NavyAI to:

Generate illegal content or facilitate illegal activities
Create content that violates anyone's rights (copyright, privacy, etc.)
Generate harmful, abusive, or harassing content
Attempt to jailbreak or manipulate AI safety measures
Impersonate individuals or organizations
Generate spam, phishing content, or malware
Overwhelm our servers with excessive requests
Resell or sublicense access without permission
Use the Service for competitive analysis or to build competing products
Generate content involving minors in any inappropriate context

5.1 Content Moderation

While we don't monitor individual requests, we may:

Implement automated systems to detect abuse patterns
Investigate accounts flagged for suspicious activity
Cooperate with law enforcement when required

6. Payment and Billing

6.1 Token-Based Pricing

Services are priced based on token consumption
Different models have different token multipliers
Premium models are only available on paid plans
Token costs are deducted from your daily allowance

6.2 Subscription Plans

Free Plan: Limited daily tokens and restricted model access
Paid Plans: Higher token limits and access to premium models
Plan upgrades through Discord support
All sales are final - no refunds, no exceptions

6.3 Billing Terms

Subscriptions are managed through Discord
No automatic renewals without explicit consent
Prices may change with 30 days notice
Existing subscriptions honored at original pricing

7. Intellectual Property

7.1 NavyAI Property

The NavyAI name, logo, and branding are our property
Our API documentation and code examples are licensed for use with our Service only
You may not copy or redistribute our proprietary systems

7.2 Your Content

You retain ownership of content you create using our Service
You grant us a limited license to process your requests through AI providers
We do not claim ownership of AI-generated outputs

7.3 AI Model Rights

AI models remain property of their respective owners
Model outputs are subject to the licensing terms of each provider
Some models may have restrictions on commercial use

8. Limitation of Liability

8.1 Service Availability

We strive for high availability but do not guarantee 100% uptime
Service may be interrupted for maintenance or updates
Performance depends on third-party AI provider availability

8.2 No Warranties

The Service is provided "AS IS" without warranties of any kind, including:

Accuracy or reliability of AI outputs
Fitness for a particular purpose
Non-infringement of third-party rights
Uninterrupted or error-free operation

8.3 Liability Limits

To the maximum extent permitted by law:

We are not liable for indirect, incidental, or consequential damages
Our total liability is limited to the amount paid for the Service in the last month
We are not responsible for AI model errors or biases
You use AI outputs at your own risk

AI models can produce incorrect, biased, or harmful content. Always verify important information.

9. Termination

9.1 Termination by You

You may stop using the Service at any time
Request account deletion through Discord support
No refunds will be done

9.2 Termination by Us

We may suspend or terminate your account for:

Violation of these Terms
Abusive or fraudulent activity
Non-payment (for paid accounts)
Extended inactivity (over 180 days)
Legal compliance requirements

9.3 Effect of Termination

API keys will be immediately revoked
Access to the Service will cease
Data may be retained per our Privacy Policy
Obligations regarding confidentiality and liability survive termination

10. General Terms

10.1 Modifications to Terms

We may update these Terms at any time
Material changes announced via Discord
Continued use constitutes acceptance of new Terms
Review Terms periodically for updates

10.2 Governing Law

These Terms are governed by applicable international law
Disputes resolved through binding arbitration where permitted
Some jurisdictions may not allow liability limitations

10.3 Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and NavyAI regarding the Service.

These Terms bind successors and assigns

Our failure to enforce any right or provision is not a waiver of that right.
